Program terms & conditions

1. About these terms

The Referral Rewards® program (the “Program”) is offered by Van Bortel Aircraft, Inc., 4912 South Collins, Arlington Municipal Airport, Arlington, TX 76018 (“Van Bortel,” “we,” “us”). By submitting a referral or creating an account on referrals.vanbortel.com, you (the “Referrer”) agree to these terms. If you are submitting on behalf of a business, you confirm you are authorized to accept these terms for that business.

2. Who can take part

• You must be at least 18 years old.
• The Program is intended for aviation businesses and aviation professionals, such as flight schools, maintenance facilities, flight instructors and mechanics. Van Bortel decides, at its sole discretion, whether a Referrer qualifies.
• Employees of Van Bortel Aircraft, Inc. and its affiliates, and members of their households, are not eligible for rewards.
• You may not refer yourself, your own business, or a purchase in which you have a financial interest.

3. Registering a prospect

• Before submitting a referral, you must have the prospect’s permission to share their name and contact details with Van Bortel and for Van Bortel to contact them about aircraft.
• All information you submit must be accurate and complete.
• A prospect must be registered before they purchase an aircraft. Purchases made before registration do not qualify.
• Van Bortel may decline any registration at its sole discretion, including where the prospect was previously registered by anyone, is already known to Van Bortel, or is already in discussions with us.
• If more than one Referrer registers the same prospect, only the first registration we accept is eligible.

4. Acceptance and lead protection

A registration counts only once Van Bortel accepts it. You can follow its status on your tracking page. An accepted lead is protected for 12 calendar months from the date of acceptance. If the prospect buys after that period ends, no reward is owed.

5. Rewards

If an accepted prospect purchases a pre-owned aircraft from Van Bortel within the 12-month protection period, and the sale closes and is paid in full:

• Referral reward: 1% of the aircraft’s sales price, paid to the referring business, or to the Referrer if no business is named.
• Individual reward: $1,000, paid to the referring instructor or mechanic named on the registration, if one was named.

Additional conditions:

• “Sales price” means the purchase price of the aircraft itself. It excludes taxes, title and registration fees, financing charges, insurance, delivery charges, trade-in allowances and any separately priced products or services.
• Rewards are paid once per aircraft sale, after the sale has closed and Van Bortel has received full payment.
• If a sale is cancelled, unwound or refunded (including under Van Bortel’s Money Back Guarantee), no reward is owed, and any reward already paid for that sale must be repaid.
• Van Bortel may ask for information needed to make a payment, such as a W-9. Rewards may be reported to tax authorities as required by law. Recipients are responsible for any taxes on their rewards.
• Rewards cannot be transferred or exchanged, and are only paid to the parties named on the accepted registration.
• Van Bortel’s records decide whether a sale qualifies, the sales price, and the reward amount.

6. Your conduct

• You take part as an independent party. You are not an employee, agent, partner or representative of Van Bortel, and you may not make promises, offers or statements on our behalf.
• You will not use spam, misleading statements or any unlawful method to find or contact prospects.
• You are responsible for following any rules that apply to you, including your employer’s policies and any requirement to tell a prospect or employer that you may receive a referral reward.
• Van Bortel may refuse or withhold rewards, and remove a Referrer from the Program, for fraud, false information or any breach of these terms.

7. No guarantee of a sale

Van Bortel does not promise that any prospect will be contacted within a particular time, offered a particular aircraft or price, or will make a purchase. Whether to sell an aircraft, and on what terms, is entirely up to Van Bortel and the prospect.

8. Changes to the Program

Van Bortel may change, suspend or end the Program, or these terms, at any time. Changes apply from the date they are posted on this page. Rewards already earned on sales that have closed before a change will still be paid under the terms in effect when the sale closed.

9. Disclaimers and limitation of liability

This website and the Program are provided “as is.” To the fullest extent allowed by law, Van Bortel is not liable for any indirect, incidental or consequential damages arising from the Program or this website, and its total liability to any Referrer for any claim relating to the Program is limited to the amount of the reward, if any, owed for the referral in question.

10. Governing law

These terms are governed by the laws of the State of Texas. Any dispute will be resolved in the state or federal courts located in Tarrant County, Texas.

11. Entire agreement

These terms, together with the program rules shown on the referral form, are the entire agreement between you and Van Bortel about the Program. If any part is found unenforceable, the rest still applies. If we don’t enforce a term right away, we can still enforce it later.

What we collect

• About you: your name, the type of referrer you are, company name, address, phone and fax numbers, email address, and the name of any referring instructor or mechanic.
• About your prospect: the details you provide, such as their name, phone or email, company, address and the aircraft they are interested in.
• Your account: if you create one, your email address and password. Passwords are stored in encrypted (hashed) form and are never visible to our staff.
• Program records: the status of each referral, notes from our team, and sale and reward details.
• Technical information: our hosting and database providers keep standard logs, such as IP address, browser type and time of access, for security and reliability.

Cookies and browser storage

We don’t use advertising or analytics cookies on this site. We use your browser’s own storage only to keep you logged in, save a referral you haven’t finished yet, and remember referrals submitted from your device so they can be added to your account. You can clear this at any time in your browser settings.

How we use information

• To review and accept referrals, and to contact prospects about aircraft.
• To send you updates about your referrals, and to send account emails such as email confirmations and password resets.
• To calculate and pay rewards, and to keep the financial and tax records the law requires.
• To prevent fraud and duplicate registrations, and to keep the site secure.

About prospects

When we contact a prospect, we may tell them that you referred them. Prospects may also receive emails from us about their inquiry. A prospect who does not want to be contacted can tell us at any time using the details below, and we will stop.

Who we share information with

We do not sell personal information. We share it only:

• With service providers that run this site for us, and only so they can do so: Supabase (database and accounts), Cloudflare (website hosting) and Resend (email delivery).
• When the law requires it, or to protect the rights, property or safety of Van Bortel, our customers or others.
• As part of a merger, acquisition or sale of all or part of our business, in which case this policy continues to apply.

How we protect it

The site uses encrypted (HTTPS) connections. Referral records can be seen only by you, through your private link or account, and by authorized Van Bortel staff. No system is perfectly secure, but we take reasonable steps to protect your information.

How long we keep it

We keep referral and reward records for as long as the Program needs them and for as long as we must keep business and tax records. After that, we delete or anonymize them.

Your choices and rights

You can ask us to show, correct or delete the personal information we hold about you, or to stop sending you referral emails. Contact us using the details below. Some records, such as reward payments, may need to be kept for legal reasons. Residents of some states have additional privacy rights, and we will honor them as the law requires.

Children

The Program is for adults. We do not knowingly collect information from anyone under 18.

Changes to this policy

We may update this policy from time to time. The effective date at the top of this page shows when it last changed.
